1. Acceptance of Terms

By accessing or using the Do App mobile application and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

Do App provides AI-powered fitness tracking, workout generation, nutrition analysis, meditation guidance, and social fitness features. Our Services include:

  • Activity tracking (running, walking, hiking, cycling, workouts)
  • AI-generated workout plans and meditation sessions
  • Food and equipment recognition using AI
  • Social feed and community features
  • Challenges and leaderboards
  • Referral program and rewards
  • Enterprise wellness solutions

3. User Accounts

3.1 Account Creation

You must create an account to use our Services. You agree to provide accurate, current, and complete information and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

3.3 Age Requirements

You must be at least 13 years old to use our Services. Users under 18 must have parental consent.

4. Acceptable Use

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload harmful, offensive, or inappropriate content
  • Harass, bully, or threaten other users
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to scrape or collect data
  • Impersonate others or misrepresent your identity
  • Interfere with the proper functioning of the Services
  • Share false or misleading health information

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of content you post ("User Content"). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with our Services.

5.2 Our Content

All content provided by Do App, including AI-generated workouts, app design, and features, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

5.3 Content Moderation

We reserve the right to remove or modify any User Content that violates these Terms or is otherwise objectionable.

6. Subscription and Payments

6.1 Pricing

Some features require a paid subscription. Pricing is displayed in the app and may change with notice.

6.2 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method automatically.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial subscription periods except as required by law.

6.4 Free Trial

Free trials may be offered for new users. You will be charged when the trial ends unless you cancel before the trial period expires.

7. Referral Program

Our referral program allows you to earn rewards by referring new users. Terms include:

  • Referral codes are unique to each user
  • Commissions are earned when referred users subscribe
  • Minimum payout thresholds apply
  • Fraudulent referrals will result in account termination
  • We reserve the right to modify or terminate the referral program at any time

8. Health and Fitness Disclaimer

IMPORTANT: Do App is not a medical device and does not provide medical advice.

  • Our Services are for informational and fitness purposes only
  • Consult a healthcare professional before starting any fitness program
  • We are not responsible for injuries or health issues resulting from use of our Services
  • AI-generated workout plans and nutrition advice are suggestions, not medical recommendations
  • Stop exercising immediately if you experience pain, dizziness, or discomfort

9. Third-Party Integrations

Our Services may integrate with third-party services (e.g., Apple Health, Strava, payment processors). Your use of third-party services is subject to their terms and privacy policies. We are not responsible for third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • DO APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
  • WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE

11. Indemnification

You agree to indemnify and hold harmless Do App, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

12. Account Deletion and Data Handling

12.1 Account Deletion

You may delete your account at any time through Profile Settings in the app. Account deletion is permanent and cannot be undone. Upon deletion:

  • All personally identifiable information (name, email, username, bio, profile picture) is permanently removed
  • Your authentication credentials are deleted, preventing future sign-in
  • Follow relationships and social connections are removed
  • Posts you created are anonymized (author shown as "[deleted]") but content is retained for community integrity
  • Referral codes are deactivated

12.2 Data Deletion Request

You may request deletion of your personal data without fully deleting your account. This removes all PII while retaining an anonymized account structure. See our Privacy Policy for full details.

12.3 Data Retention

After deletion, we retain anonymized, non-identifiable data for legitimate business purposes including service improvement, fraud prevention, and legal compliance. A deletion audit log (containing only a hashed email and timestamp) is retained for up to 3 years. Financial transaction records are retained as required by applicable tax and accounting laws.

12A. AI Services (Genie)

Our AI assistant ("Genie") provides personalized fitness recommendations, workout plans, meal analysis, and other AI-powered features. By using Genie:

  • You acknowledge that AI-generated content is for informational purposes only and does not constitute medical, nutritional, or professional advice
  • You understand that AI responses may not always be accurate and should be verified
  • You consent to your fitness data and queries being processed by AI models to generate personalized responses
  • You acknowledge that Genie credits are non-refundable once consumed
  • New users receive 20 complimentary Genie credits upon signup; additional credits may be purchased

12B. Consent and Agreement

By creating an account, you explicitly confirm that:

  • You have read and agree to these Terms of Service
  • You have read and agree to our Privacy Policy
  • You are at least 13 years of age (or have parental consent if under 18)
  • You consent to the collection and processing of your data as described in our Privacy Policy
  • You understand that health and fitness features are not medical advice

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason. You may delete your account at any time through the app settings.

Upon termination, your right to use the Services ceases immediately. Provisions that should survive termination (e.g., liability limitations, indemnification) will remain in effect.

14. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13.2 Arbitration

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration, except for small claims court matters. You waive your right to a jury trial and class action lawsuits.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Services after changes constitutes acceptance of the new Terms.

15. Enterprise Customers

Enterprise customers may have separate agreements that supersede these Terms. Contact us for enterprise pricing and custom terms.

16. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Do App
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • No Waiver: Our failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms; we may assign them without notice
